1. Who we are and scope

KOLHero is operated by Talk Arc LLC, a Delaware limited liability company (“Talk Arc,” “we,” “us,” or “our”). This Privacy Policy explains how we handle personal information when you visit kolhero.com, create or use a KOLHero account, search creator data, import contacts, use outreach workflows, make a payment, or contact us (collectively, the “Service”).

For account administration and operation of the Service, Talk Arc determines why and how personal information is processed. When a business customer uploads contacts or other personal information and directs us to process it through the Service, that customer is responsible for its purpose and lawful use, and we process the data to provide the requested functionality. Legal roles may vary under applicable law.

2. Information we handle

We may collect or process:

  • Account and profile information: name, email address, authentication identifiers, organization, account settings, and authorized users.
  • Usage and technical information: searches, pages and features used, credit activity, timestamps, IP address, browser and device information, referral information, error logs, and security events.
  • Public creator information: names, handles, profile URLs, biographies, content categories, posts or content metadata, audience and engagement metrics, location or language indicators, and business contact details made public on social platforms or supplied by data providers.
  • Customer-provided content: uploaded or entered contacts, lists, notes, tags, search criteria, campaign or outreach content, and related workflow or activity records.
  • Payment and subscription information: plan, credits, amount, currency, transaction identifiers and status, billing or contact information, refund or dispute information, and limited payment-related data made available by Airwallex. Airwallex collects payment and fraud-prevention information directly when you use its payment flow.
  • Communications: support requests, feedback, and other messages you send us.

You may choose not to provide information, but some information is required to create an account, run a search, process contacts, use outreach features, or complete payment.

3. Sources of information

We receive information:

  • directly from you, your organization, or other users acting for your organization;
  • automatically from your browser, device, and use of the Service;
  • from public social-platform pages and other publicly available online sources;
  • from third-party data suppliers that retrieve, license, organize, or enrich public creator information; and
  • from service providers such as Descope and Airwallex.

Public availability does not remove all privacy or outreach obligations. Users must use creator and contact information lawfully.

4. How we use information

We use personal information to:

  • create, authenticate, secure, and administer accounts;
  • provide creator search, contact import and management, outreach workflows, subscription, and credit features;
  • process payments, refunds, disputes, and related records;
  • respond to support requests and send service communications;
  • monitor performance, understand feature use, troubleshoot, maintain, and improve the Service;
  • detect, prevent, and investigate fraud, abuse, security incidents, and violations of our terms; and
  • comply with law, enforce agreements, and establish or defend legal claims.

Where applicable law requires a legal basis, we rely as appropriate on performance of a contract, our legitimate interests in operating and securing the Service, compliance with legal obligations, and consent when required. You may withdraw consent where processing depends on consent, without affecting earlier lawful processing.

5. How we disclose information

We disclose information only as reasonably needed for the purposes described above:

  • Descope provides identity, login, and account-authentication services and processes related account, authentication, device, and security data. See Descope’s Privacy Policy.
  • Google Cloud provides application hosting, storage, networking, monitoring, and related infrastructure and processes the data hosted in those services. See the Google Cloud Privacy Notice.
  • Airwallex processes payments and related billing, transaction, device, risk, fraud-prevention, refund, and dispute information. Airwallex may act under its own legal obligations and privacy terms. See Airwallex’s Global Privacy Policy.
  • Data suppliers provide public creator profiles and enrichment and may receive the search criteria or creator identifiers needed to fulfill a lookup.
  • Other vendors and advisers may support communications, security, support, analytics, or professional services, with access limited to what is reasonably needed for their role.

We may also disclose information when required by law or legal process; to protect the Service, users, Talk Arc, or others; in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of all or part of the business; or with your direction or consent.

6. Uploaded contacts and outreach

Business customers decide which contacts to upload and how to use them. Before uploading or contacting a person, you must have any notice, consent, permission, or other lawful basis required by privacy, anti-spam, marketing, consumer-protection, and platform rules. Do not upload sensitive information unless the Service expressly supports it and you are legally authorized to do so.

If you receive outreach sent by a KOLHero customer, that customer is responsible for the message and recipient selection. You may contact the sender directly about the message and may also contact us about the use of the Service.

7. Retention

We retain information for as long as reasonably necessary to provide and secure the Service, maintain account and transaction records, comply with law, resolve disputes, and enforce agreements. Retention varies by data type, account status, legal obligations, and operational need.

When information is no longer reasonably needed, we may delete or de-identify it. Deletion requests may not remove information we must retain for legal, accounting, fraud-prevention, security, backup, or dispute purposes. Public creator information may remain available from its original source or be provided again by a data supplier even after it is corrected or removed from our active records.

8. International processing

Talk Arc is based in the United States and operates remotely. We and our providers may process information in the United States and other countries where they operate. Those countries may have different data-protection laws. Where required, we use an available lawful transfer mechanism or other required safeguards.

9. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information. No service or transmission is completely secure, so we cannot guarantee absolute security. You are responsible for protecting your account credentials and notifying us of suspected unauthorized access.

10. Your choices and rights

Depending on where you live and subject to legal exceptions, you may have rights to request access to, correction of, deletion of, or a copy of personal information; object to or restrict certain processing; withdraw consent; or appeal our response. You may also have the right to complain to a privacy or data-protection authority.

If a creator profile is about you, you may ask us to review, correct, or remove information associated with you. We may need to verify your identity and the relevant profile before acting. Removing information from KOLHero does not remove it from the original public source or an independent data supplier.

To make a request, email contact@talkarcllc.com. Tell us the right you wish to exercise, the relevant account or creator profile, and your country or state. We will respond as required by applicable law. You may use an authorized agent where applicable law permits, subject to verification.

11. Children

The Service is a business tool and is not intended for account holders under 18. Do not create an account or upload information through the Service if you are under 18. If you believe a minor’s personal information has been improperly submitted to the Service, contact us so we can review it.

12. Changes

We may update this Privacy Policy as the Service, providers, or legal requirements change. The revised policy will state its effective date. If a change is material, we will provide reasonable notice through the Service, by email, or on our website as required by law.

7. 保存期限

我们会在提供和保护服务、维护账号及交易记录、遵守法律、解决争议和执行协议的合理必要期限内保存信息。具体期限因数据类型、账号状态、法律义务和运营需要而异。

信息不再有合理需要时，我们可能删除或去标识化处理。删除请求可能不会移除因法律、会计、反欺诈、安全、备份或争议需要而必须保留的信息。即使我们更正或从活跃记录中删除公开达人信息，该信息仍可能存在于原始来源，或由数据供应商再次提供。

8. 跨境处理

11. 未成年人

12. 变更

我们可能随服务、供应商或法律要求的变化更新本隐私政策。修订政策将注明生效日期。若变更重大，我们会按法律要求通过服务、电子邮件或网站提供合理通知。
